In a divorce or marital dissolution, most of a couple’s assets and liabilities must be valued. This is usually true regardless of whether a state follows community property or equitable distribution rules or not.

If one of these assets is a closely held business, the business must be valued by an independent, professional business appraiser. This will give the judge and each spouse’s legal counsel an accurate and objective business value that can be used to distribute assets to each party.

Each state has its laws governing marital dissolutions and the definition of business value, so the business valuator must be familiar with these laws. For example, goodwill associated with a professional is excluded from distribution in some states but includable in others.
